Terms of Service
These terms are an agreement between you and [ENTITY LEGAL NAME, e.g. EvenlyTaxed LLC] (“EvenlyTaxed,” “we,” “us”). By using evenlytaxed.com or purchasing a service, you agree to them. If you do not agree, do not use the site.
1. What we do — and what we are not
We help Texas homeowners identify a missing residence homestead exemption and claim it, including refunds for prior tax years allowed under Texas Tax Code §11.431. We are not a law firm and do not give legal advice. We are not affiliated with any appraisal district, the Texas Comptroller, or any government office. You can file a homestead exemption yourself, for free, directly with your appraisal district.
2. Estimates
Savings and refund figures on the site are estimates calculated from the current public appraisal roll and published tax rates. They are not a guarantee. The appraisal district decides whether to grant an exemption, for which years, and in what amount; the tax collector determines any refund.
3. DIY Kit
The DIY Kit is a self-service product: a pre-filled Form 50-114 and written instructions, delivered by email. You review, complete, sign, and file the application yourself. We do not act as your agent and do not communicate with the appraisal district on your behalf. The kit fee is stated at checkout and charged when you order. Refund guarantee: if the appraisal district denies a complete and timely application prepared from the kit, email us the denial notice within 60 days and we will refund the kit fee in full.
4. Done-for-you service
With done-for-you service, a licensed Texas property tax consultant registered with the Texas Department of Licensing and Regulation files your application as your designated agent under Texas Tax Code §1.111 and Form 50-162. You will sign the agent appointment and a separate service agreement that sets the fee; if these terms and the service agreement conflict, the service agreement controls.
- Nothing upfront. We save a payment method when you sign. We charge only after the appraisal district approves your exemption and your taxable value is reduced.
- Fee. [$149] plus [35%] of any prior-year refund attributable to the exemption we obtained, as shown before you sign. If nothing is approved, you owe nothing.
- Notice before charging. We email you the approval, the amount, and the charge date at least 3 days before charging the saved payment method.
- Your cooperation. You confirm the information you give us is accurate and that you own and occupy the property as your principal residence. Approval depends in part on your Texas ID showing the property address.
- Cancellation. You may cancel before filing at no charge by emailing us. After filing, the fee applies if the exemption is approved. You may revoke the agent appointment at any time by filing a revocation with the appraisal district.
5. Your responsibilities
You must be an owner of the property, provide accurate information, and be entitled to the exemption you claim. Filing a false application with an appraisal district is an offense under Texas law. You are responsible for reading what you sign.
6. Payments
Payments are processed by Stripe. Prices are in U.S. dollars. If a charge fails, we will invoice you and you agree to pay within 30 days. Fees are non-refundable except as stated in Sections 3 and 4.
7. Communications
By providing an email address you agree to receive transactional email about your filing. Text messages are sent only if you opt in; reply STOP to cancel.
8. Intellectual property and acceptable use
The site, its data compilation, and documents we prepare are ours or licensed to us; you may use documents we prepare for you to file your own application. You may not scrape, bulk-download, or resell data from the site, use automated tools against it, or use it to solicit property owners.
9. Disclaimers and limitation of liability
The site and services are provided “as is.” To the fullest extent permitted by law, we disclaim all warranties, and our total liability to you for any claim arising from the services will not exceed the fees you paid us in the 12 months before the claim. We are not liable for the decisions of any appraisal district or tax collector, or for delays in their processing.
10. Disputes
These terms are governed by Texas law. Any dispute will be resolved in the state or federal courts located in [COUNTY, e.g. Travis County], Texas, and you consent to their jurisdiction. [OPTIONAL: arbitration clause — counsel to decide]
11. Changes
We may update these terms; the date above will change and material changes will be emailed to customers with active filings. Continued use after a change means you accept it.
